View from the Stage: Six Pounds Tall!

The other day I was “putzing” around in the garage when Andrew, (my “little guy”) approached. With great curiosity asked “whatcha doin’ Dad?”"I’m building an atomic fission accelerator little guy,” I teased. “Oh, Can I watch?” (no doubt he had never seen anyone build one of those before…)
“Sure.”

It wasn’t long before Andrew’s attention drifted from my work to a twenty-five foot measuring tape laying on the bench nearby. After examining it for a moment, he proceeded to measure the distance between my left knee and my right wrist. He studied the numbers with great intensity, then he was ready to present his findings. “Gee Dad, you’re Six Pounds Tall!” he said with obvious pride.

I contained my laugher and delight and answered, “Well Andrew, looks like I’m growing again.”
“Yes” he said, “we all are.” And do you know something? He was right.

I showed him how to clip the end of the tape onto an object and to read the numbers. Immediately after acquiring this new skill, Andrew was off on a mission to quantify his world. He measured and measured and measured for hours.

It can be like that for us onstage. We have wonderful equipment “tools” of our trade. We have the desire to grow. We have friends, fans, and family to help us through the process. We just need to take that first step forward and pursue building our skill sets.

It’s a new age. I encourage everyone to develop an action plan. Not a big complex comprehensive plan for years down the line, but a plan for the next few weeks. Pick out an area of focus or a skill that you would like to add to your “bag of tricks.” It doesn’t have to be something difficult; in fact some of the best ideas are simple ideas. Make an effort to learn the art and science of networking or perhaps the marketing process; make it interesting to you. Keep chasing your goals a few weeks at a time. We live in a complicated environment, but as the saying goes “Even an elephant must be eaten one bite at a time.”

Don’t forget business. Make a point this year to learn more about your business. How does your sound relate to your goals? Who are the big players? Like musical knowledge, business knowledge will help us grow as professionals. It’s a Win-Win situation; everybody gains, everybody is proud of the accomplishment.

Andrew is right; we all are growing. As for me I’m six pounds tall already. He told me so and he ought to know, because he still has my “measure-er.” I’m never going to get that thing back.

The Current Laptop Trends

Demand for notebooks is sky high at the moment. It looks like the unfortunate manufacturers are also facing issues that could keep us all waiting. Laptops have been a growing market year on year for a number of years now and it look set to be that way. It’s a rapidly changing market that is witnessing new trends all the time.

With all the new advances in technology gaming laptops have capitalised a great extent in my opinion. With prices dropping and new technology being released rather rapidly it means that consumers are getting greater bangs for their buck. Playing games on laptops is indeed a reality now with the breakthroughs in technology. These days the large number of gaming laptops aren’t even big, chunky and noisy. Regardless of the fact that speed has majorly advanced and the designs are attractive, honestly speed will and should always lag behind desktops. Gaming laptops will undeniably get streamlined and more powerful in the coming years and it will be fascinating to witness.

Sometimes the average mass market notebooks just aren’t adequate for what we require them for so custom laptops will always be here. The thought of getting third party components compels some people in my view. With that in perspective you normally get to specify the cpu, memory, storage and os. The computers found in stores are commonly configured based normalpopular, mass market people and well not everyone is average now are they? You can get a far suitable laptop by buying one built to spec. You can a plethora of companies who sell straight to the buyer so there are a lot of alternatives as well. To me this is a massive positive.

I can’t wait to see what notebook computers are introduced next. Laptops simply for accessing the world wide web etc are hitting the market one after the other. An entirely new market has been made overnight it seems. I would like to see a larger version of these low cost ultra mobiles. I feel it could be a massive success. I firgure getting an attractive price mark is a main roadblock in all this. Surely the technology is accessible. Analysing the trends it seems like gaming laptops will become thinner and more powerful. What will be released next? Begin employing your creativity.

Mortgage Refinance - Should You Take Out All Your Equity?

As more lenders offer the option to borrow 100percent of the value of property, homeowners are finding themselves faced with the question of how much they should borrow. This is especially true if you’ve established some equity in your home and are now looking toward a mortgage refinance. So should you take out a loan that equals 100 percent (or more) of the value of your home? Weigh your options before you make this decision.

The fist thing to consider is why you would want to refinance at 100 percent. Do you have a good use for the money or would it just be nice to have it? If you’re looking at buying something or paying off something, that home equity could be put to good use and the mortgage refinance at 100 percent of the value of your home could be a great idea. For example, if you have accrued significant credit card debt, you’re probably paying several hundreds of dollars each month in fees and interest. Paying the minimum monthly payments will hardly even make a dent in the amount owed and you’re likely going to pay thousands over the course of the debt. Instead of plodding along with those monthly credit card payments, a mortgage refinance could give you the money you need to pay the debt off completely. As a rule, you’ll be paying a much lower interest rate on your mortgage refinance than on the credit card debts.

Don’t forget to consider the amount of closing costs associated with your mortgage refinance, and also keep in mind that you’re going to be making a larger monthly house payment or making those payments for a longer period of time. Be sure you can meet those requirements.

You may also find that the equity can be put to good use for college tuition, buying a new car or even financing something you’ve been unable to afford any other way - a vacation or a down payment on a vacation home. You’ve worked hard to accrue that home equity and some people feel that they should put that asset to work. A mortgage refinance will allow you to do just that.
There’s no doubt that your home equity is an asset. There’s also no doubt that many people simply accept the fact that they’ll make a mortgage payment for their entire lives. However, keep sight of the fact that you may not always have to make those mortgage payments if you put your efforts toward paying down the loan. Instead of a mortgage refinance, it may be time to focus on making some extra payments.

At the end of the day, only you can decide which course of action is best for you. If you do decide to refinance your mortgage, be sure that you have all the information you need to take this step wisely.

Dangerous Shoulder Exercises

Have you ever suffered from shoulder discomfort after working out? I am referring to aching or sharp pain experienced in the front of the shoulder or lateral upper arm that is felt with overhead activities, reaching behind the back or even laying on the shoulder. These symptoms are often indicative of rotator cuff inflammation. This is a common problem for many people who perform resistance training on a regular basis. It is also a problem that can easily be prevented by modifying the following “dangerous shoulder exercises.”

Bench Press - This is a popular exercise chosen to build the chest, along with the anterior deltoid and triceps. Most teach taking the bar down until it lightly touches the chest. However, I believe this is unsafe because it exposes the anterior shoulder capsule to excessive load, in addition to compressing the soft tissue of the rotator cuff between the humerus and the acromion. Over time, with repeated bouts and heavy loads, the rotator cuff becomes inflamed.

Individuals with any anterior shoulder laxity (loose joints) or history of subluxation/dislocation are also at increase risk for rotator cuff injury or labral (shoulder cartilage) damage. Furthermore, you also have the potential to rupture the pectoralis tendon with full range pressing during heavy loads. The safe answer is to lower the bar until the upper arm is parallel to the floor (elbow bent to 90 degrees). This prevents the shoulder joint from moving into the unsafe range. The same advice applies to push-ups.

Lat Pull Downs - This is a good exercise to strengthen the back, but when done behind the head it can cause problems. Like the bench press, pulling the bar down behind the head positions the humerus in such a way that the rotator cuff can be pinched. This may depend on other factors, including the shape of a person’s acromion and degree of any present arthritis, but I still believe the risk outweighs any benefit. Not to mention that keeping the bar in front of the head still accomplishes the same movement for the target muscle, while eliminating the risk of shoulder injury. Remember not to sway during the movement, and position the body in a slightly reclined position, pulling the bar toward the sternum. Another unrelated reason not to do behind the neck pull downs is that it places undue stress on the cervical spine.

Military Press - This exercise when performed behind the neck with a bar, positions the shoulder in the aforementioned unfavorable position. Done repeatedly, the rotator cuff can become inflamed. Similar to behind the neck pull downs, you also expose your neck to unnecessary stress. It is safer to perform the exercise in front of the head or utilize dumbbells and work in the scapular plane. You must watch to avoid arching the low back and it is best to use a bench with back support to prevent this.

Dips/Upright Row - As before, the key mistake made with these exercises is allowing the shoulder to move beyond 90 degrees relative to a position parallel to the floor or perpendicular to the body. I always recommend stopping at 90 degrees to protect the shoulder capsule and the rotator cuff.

Dumbbell Lateral Raise - In my opinion, this exercise is often done incorrectly. The mistakes include lifting too much weight, keeping the arms straight, and raising the arms out away from the body in the plane of the body. The force on the rotator cuff reaches 90% of your body weight when the arms are raised to 90 degrees with the arms straight and in the plane of the body. That is a lot of force on four relatively small rotator cuff muscles. The target muscle is the lateral deltoid, but the rotator cuff is extremely active, and it functions to allow you to raise the arm by depressing the humerus so that it passes under the acromion during active elevation. When heavy loads are introduced in the wrong plane of motion, disaster usually occurs. I am fanatical about performing this exercise correctly.

The proper way to execute a lateral raise is to keep the elbows comfortably flexed (20-30 degrees) and raise the arm to no higher than parallel to the floor. The arm should be in the scapular plane of motion (approximately 30-45 degrees from being perpendicular to the body) and the weight should be relatively light. Once you feel you have to shrug or use momentum to raise the weight, you need to rest or lower the weight. In my opinion, this is one of the worst exercises for the shoulder if done incorrectly.

In summary, I want to emphasize that good intentions may spell bad results for the shoulder if proper form is lacking. The rotator cuff and shoulder joint is extremely vulnerable to heavy loads and repetitive bouts of exercise. Gradually, it may become inflamed and hinder or limit your workout altogether. Be sure to master form before increasing weight, and do not attempt to work through pain, as this often perpetuates the problem. Remember to assess risk and reward at all times, and rest assured that these modifications will not hinder your gains. Instead, they will prevent missed time in the gym and produce happier, healthier shoulders!

Arbitration And The Lemon Law

If the neighbor’s Pekinese decides to scare off bad guys at 2:00AM in the morning, and does this every night, and you can’t persuade your neighbor to correct the situation, perhaps mediation or arbitration is the answer. After all, going to court seems a bit much, and committing crimes against the little $%%$# is probably counter productive.

I say this by way of introducing the fact that your long battle against the Fords or Mercedes’ of the world isn’t at all like getting the neighbor’s lap dog to be quiet. There are situations where arbitration or a dispute resolution process is entirely appropriate. However we want to say it right up front, after over four thousand five hundred lemon law cases we have almost never seen a case where the vehicle owner benefited from arbitration with a manufacturer.

It is an unequal battle that is but one step in a long war. The outcome is inevitable. To engage in this war is equivalent to a middle-aged, non-athletic accountant, dedicated to ribs and beer stepping into the ring with the young Muhammad Ali. You won’t even see that sweet left hook coming. Everything is on the side of the manufacturer.

Sun-tzu in the “The Art of War” wrote, “Generally in warfare: if ten times the enemies strength, surround them; if five times, attack them; if double, divide them; if equal, be able to fight them; if fewer, be able to evade them; if weaker, be able to avoid them.” I hate to be the one to break the news but consumers very definitely fall in the latter two categories. Consumers going into arbitration have fewer soldiers and are certainly weaker.

In California two things level the playing field. A strong lemon law - the Song Beverly Act - and very experienced lemon law attorneys. We should have these things, after all California has more cars on the road than any other state.

Lets look at a definition of Arbitration: “The process by which the parties to a dispute submit their differences to the judgment of an impartial person or group appointed by mutual consent or statutory provision.” With very few exceptions you can forget impartial and mutual consent.

If Saddam Hussein offered to arbitrate detente between Islam and Israel, I for one would have problems with the impartiality of his decision. Mr. Hussein will never be found on the moral high ground. Arbitration can be similarly unequal. Fairness, equity and the proper application of the law are what should occur in arbitration. If you want the consumer to accept arbitration that is sponsored by an automobile manufacturer, or where the arbitration organization receives most of its business from automobile manufacturers, then I give you the same answer Israel would give Saddam. “Forget it! Not on your best day, sport!”

There are other factors that unfortunately work against arbitration being an equitable solution for consumers with lemon vehicles.

Training

Professional arbitrators are not necessarily trained in the lemon law, in fact it is far more likely that they have no training in the subject at all. Arbitrators are rarely judges or lawyers. Generally the arbitrator is trained in so-called people skills, how to negotiate and perhaps a smattering of legal knowledge. This is a subject area where a little knowledge is very definitely dangerous. Perhaps the arbitrator imagines he or she can get by on common sense and honesty. If it were true the consumer would seldom lose a case.

Are consumers properly prepared for arbitration?

How could they be, even if they read the Song Beverly Act, or anything else? Even with all the facts, consumers don’t know what to expect. Consumers aren’t all lawyers. The manufacturer will send a lawyer trained to handle this sort of thing. The manufacturer’s lawyer may lie; that’s correct, lie. There’s not much consumers can do about that except feel miserable. Whether the manufacturer s representatives lie or not, they will present a blizzard of bizarre possibilities, all designed to confuse and dilute the consumer’s case.

Is arbitration binding?

There is light at the end of this particular tunnel, however. In California, arbitration is not binding; it’s just another waste of time. When the ruling is handed down, and the manufacturer is permitted another repair attempt, consumers need not comply, consumers can get a lemon law attorney and put an end to the endless games manufacturers play.

Cost

Even if the arbitration is paid by the state, what is often ignored is the lost time from work, expenses for experts where expenses are required, copying, and running around to get copies of missing paperwork. Then there is the time spent preparing an oral argument, trying to figure out how to answer the manufacturer’s defenses. Of course, if the manufacturer runs the arbitration, this is no arbitration at all.

How long does it take?

If consumers get this far they have often been trying to get the dealer/manufacturer to do something about their car for many months, even years. Arbitration adds another 30-90 days onto to the process. If the car is dangerous to drive what do consumers do? Are they supposed to endanger themselves and their families in an attempt to finally get the problem resolved? Should they do this, especially when there is a better than even chance that more delay will be added into the process by awards of additional repair attempts? This is hardly a fair and equitable solution to the problem.

A little known fact

All major vehicle manufacturers have networks of dealerships all across the country and even the world. Manufacturers enter into contracts with dealerships. These contracts affect every aspect of sales, maintenance and repair of their vehicles. More frequently than the public ever discovers, there are disputes between dealerships and manufacturers. Dealerships want uniform arbitration procedures and laws to help them deal with these disagreements. Guess who fights any sort of arbitration with dealerships? Exactly! The manufacturers. And yet, the manufacturer touts the benefits of the arbitration/dispute resolution process when it comes to consumers. What’s wrong with this picture?

Remember, if the manufacturer wants arbitration, it’s not good for the consumer:

Arbitration does not take place on a level playing field. At Norman Taylor & Associates we have seen enough cases to know this. The two sides have very different goals. Consumers simply want vehicles that work as advertised. The manufacturer does not want to give consumers a refund or replacement for their defective car and then be stuck with a vehicle that is worth half its current value, and may be impossible to fix or to sell.

From the manufacturer’s point of view they have every incentive to make the entire process so difficult that consumers will give up and go away. Don’t do it, Mr. and Mrs. Consumer. With professional help you can prevail. Absolutely nothing beats winning a hard fought battle when you are right.

Tile floors, known for their durability, are aptly suitable for almost every room from hallways to living rooms and from kitchen to bathrooms. Culture As A Barrier To Communication

Each of us is exposed to people from other cultures on a regular basis, in the workplace, in our social activities, at school, or even within our families. Our culture hinders us from getting our message across as well receiving the full message that others want to convey to us. This article expound on three aspects: what culture is, the main causes for cross-cultural misunderstandings, and the attitudes and skills that we need to communicate cross-culturally.

When we think about culture we first think about a country, and particularly about its food, art, customs, and patterns of behavior. These are the outward manifestations of a system of values, assumptions, and deeply rooted beliefs. Culture emerges as a group of people face and then react to the challenges of life. The responses to those challenges that are successful are taught and shared among members of the group and are passed on from the older to the younger members. Culture is then learned through experience.

You can think of culture as having three levels:

• The top level is the outward manifestations, the artifacts: visible behavior, art, clothing and so on.

• In the middle level are the values. These are invisible rules that cause the artifacts

• The most powerful dimension of culture is the implicit cultural assumptions. These assumptions lie so deep that they are never questioned, stated or defended

Culture also exists among Americans, but what are the implicit cultural assumptions of Americans? Some of the most distinctive characteristics of the American culture are: individualism, equality, competition, personal control of the environment, self-help concept, action orientation, informality, directness, practicality, materialism, and problem-solving orientation.

These American values and deeply rooted beliefs are very different from other country’s values and beliefs. The implicit cultural assumptions of Americans are often opposed to those of other cultures. When individuals from different cultures run into each other’s values and beliefs, cross-cultural misunderstandings take place.

People constantly interact with people who have similar views and who reinforce their beliefs. To be able to distinguish between the in-group and the out-group is of central importance for individuals because it allows them to find an identity as to who they are and who they are not.

In the book entitled Cross Cultural Encounters , Brislim states: “If individuals have out-groups whom they can blame for troubles, the in-group is then solidified since there is a common goal around which to rally.” Later on he says: “Individuals become accustomed to reacting in terms of in-group and out-groups. They continue to use such distinctions when interacting with people from other cultures whom they do not know.”

This in-group/out-group distinction provides us with the basis for ethnocentrism, which is the tendency to interpret and to judge all other groups, their environment, and their communication according to the categories and values of our own culture. We are guilty of ethnocentrism when we hold that our view of the world is the right one, the correct one, and the only one.

We are all familiar with stereotyping, which is one of the most serious problems in intercultural communication. Our tendency to hold beliefs about groups of individuals based on previously formed opinions, perceptions, and attitudes is often a defense mechanism, a way of reducing anxiety.

There are many other causes of cross-cultural misunderstanding: lack of trust, lack of empathy, and the misuse of power. All of us know what they are about and the turmoil that they cause. But, how can we do a better job at communicating among cultures?

The same skills that we need to communicate in general apply to cross-cultural communication. Lets look at some of those skills:

Know yourself: Identify your attitudes, your opinions, and the biases that we all carry around. Identify your likes, your dislikes, your prejudices, and your degree of personal ethnocentrism.

Take time: Listen to the other person and allow him or her to accomplish their purpose. Don’t jump to conclusions. Some times we finish the thoughts and ideas of the other person before he or she has finished talking. Some cultures non-verbal styles call for periods of silence and long pauses.

Encourage feedback: Feedback allows communicators to correct and adjust messages. Without feedback we cannot have agreement. First we must create an atmosphere where others are encouraged to give us feedback. Again, don’t be afraid of silence. It could be the appropriate feedback at times.

Develop empathy: The grater the difference between us and others, the harder it is to empathize. To develop empathy we must put ourselves in the other person’s place. By becoming more sensitive to the needs, values, and goals of the other person, we overcome our ethnocentric tendencies.

Seek the commonalities among diverse cultures: Despite our cultural differences we are all alike in many ways. We need to seek that common ground to establish a bond between ourselves and the rest of humanity.

Although our own ethnocentrism might have hindered us from getting to know people from other cultures, let us be more than ever committed to help ourselves and others overcome the barrier that culture creates. Let us endeavor to minimize the occurrences of cross-cultural misunderstandings as we develop the attitudes and the skills that are needed to communicate cross-culturally.

Negotiating Real Estate - Go Slow

Why should you sometimes go slow when negotiating real estate deals? It’s all about the power of time investment. Let me explain with a story.

One of my less-pleasant experiences selling real estate was when I sold a home for a real decent guy, and the buyer was a lawyer. I was new to real estate, and this lawyer knew all the angles. Without getting into all the dirty tricks he used, I’ll just say that the buyer had everyone involved angry, frustrated and worn down.

As a final blow, he arbitrarily decided that he wanted the price lowered by another $5,000. Now that’s hardball negotiating. The seller was almost ready to throw away the whole deal, but he had been trying to sell the home for two years, and we had been working with this buyer for months. None of the agents or brokers involved wanted to see all their effort go for nothing.

There were three agents under two brokers involved in the sale. We all agreed that suing the buyer wasn’t worth it. Instead, we gave in. The seller had enough of the buyers tricks, so each of the other five parties to the sale (3 agents, 2 brokers) agreed to each forfeit a $1,000 of the commission, just to make the deal close.

This is an extreme example of using “time investment” to your advantage. After investing so much time, none of us wanted to lose everything. The lawyer knew that, and used it. In this case, there was nothing in the contract that allowed him to renegotiate the price, making it unethical in my mind. Still, it was effective.

Negotiating Real Estate Deals - Ethically

In other cases, it is just good negotiating. If you want to get the best price on a car, do you think you’ll get it after spending two minutes with a salesman? Let him invest two hours showing you cars, and he’ll be begging the manager to let the car go for your low offer. The same is true with real estate negotiation.

Remind the seller about time, to let him remember the time he has already invested. To do this politely, say something like “Look, neither of us wants to lose the time we’ve spent on this and start all over, so why don’t I…” Then offer some small concession.

He is subtly warned that he could lose his whole time investment with nothing to show for it. The words “start all over” may even scare him. You set the scene, and then you offer a way out. This is non-offensive too, if done right. You say “Neither of us…” to let them know you’re both in the same situation, and it’s not just you threatening them.

This is, of course just one technique of many for negotiating real estate deals. Take the time to learn several, at least.
